1.3 Information Obtained from Third Parties
If you log in through third-party platforms (e.g., Google, Apple), we may obtain your public information from such platforms (e.g., email address).
2. How We Use Your Information
We process your information for the following purposes:
- Providing Services: Processing your AI generation requests, storing your account settings and history, and synchronizing data across devices.
- Security and Fraud Prevention: Detecting and preventing fraud, abuse (including violations of our prohibited conduct policies such as watermark removal), illegal activities, or technical security issues.
- Communication and Marketing: Sending service notifications (e.g., renewal reminders, policy updates) and responding to customer support requests. Promotional communications will only be sent with your explicit consent.
- Legal Compliance: Responding to lawful requests from law enforcement or protecting our own and our users' legal rights.
3. How We Share and Disclose Your Information
Except as described below, we will not sell, trade, or transfer your personal information:
- Service Providers: We may share information with third parties that assist in our operations (e.g., cloud storage providers, CDNs, payment processors, analytics tools). These providers are only permitted to use your information as necessary to provide services and are bound by confidentiality obligations.
- Legal Requirements: When we reasonably believe disclosure is necessary to: (a) comply with a legal obligation or legal process; (b) protect the rights, property, or safety of Vorla, our users, or the public; or (c) investigate violations of our Terms of Service (e.g., generating illegal content or unauthorized watermark removal).
- Business Transfer: In the event of a merger, acquisition, or asset sale, your information may be transferred as part of the assets. We will notify you in advance.
- With Your Consent: Upon obtaining your explicit consent. We will not: Share your personal identifying information with advertising networks or data brokers for commercial purposes without your explicit consent. We also will not sell your original images or videos directly to third parties.
4. Special Handling of User Content (AI Service Related)
- Input Content: The text prompts and visual materials you upload will be transmitted to AI model servers for processing. We use this content solely to execute your generation instructions and for no other purpose.
- Output Content: You retain ownership of all generated images, videos, and other outputs. Your content is private to you by default (unless you actively share it). However, we may need to store these outputs so you can view, download, or re-edit them in your history.
- Content Moderation: To comply with Section 5 of our Terms of Service (Prohibited Content), we may use automated tools (including AI models) to scan user content to detect and block illegal, pornographic, violent, or otherwise restricted content. Human reviewers may review content samples in limited circumstances, such as serious violation reports or legal requirements.
- Minor Protection: For known users aged 13–18 (using the service under parental supervision), we apply stricter filtering measures to their content and restrict features that may generate mature content.
5. Data Storage and Security
- Storage Location: Your personal information and user content will be stored on our cloud service providers' servers.
- Credit Validity: As stated in Section 7.2 of our Terms of Service, purchased credit packs are valid for 180 days. Unused credits will expire after that period, and related records may be deleted.
- Security Measures: We implement industry-standard encryption technologies (TLS for transmission, AES-256 for storage), access controls, regular security audits, and other measures to prevent unauthorized access, disclosure, or loss. However, no internet transmission is 100% secure.
6. Your Rights and Choices
Under applicable data protection laws (e.g., GDPR, CCPA), you may have the following rights:
- Access and Correction: View and update your personal information through account settings.
- Deletion: Request deletion of your account and associated content. You may initiate deletion at any time through "Account Settings" (Terms of Service Section 8.1).
- Restriction of Processing: Object to specific uses (e.g., direct marketing).
- Data Portability: Request export of certain information you have provided.
- Withdraw Consent: You may withdraw consent at any time for information collected on the basis of consent (e.g., marketing cookies).
- If you are a minor (13–18 years old): You must have parental/guardian consent to use our services. Your guardian has the right to exercise these rights on your behalf and to review your activity.
- If you are a parent/guardian: If you become aware that your minor child has provided us with personal information without your consent, please contact us immediately.
7. International Data Transfers
Because we use globally distributed cloud service providers, your information may be transferred to jurisdictions other than your own. The data protection laws in those jurisdictions may differ from those in your country. We commit to implementing appropriate safeguards (such as Standard Contractual Clauses) to ensure your information receives an adequate level of protection.
8. Third-Party Links
Our services may contain links to third-party websites. This Privacy Policy does not apply to those websites. We encourage you to read the privacy policies of any third-party websites you visit.
9. Content Rights, Watermarking, and Acceptable Use
9.1 Rights and Identification of AI-Generated Content
- Ownership: As stated in Section 6.2 of our Terms of Service, you retain full ownership of all outputs (images, videos, etc.) generated using Vorla. You are free to use generated content for personal or commercial purposes, provided you do not violate our prohibited conduct rules (e.g., generating illegal or infringing content).
- Voluntary Watermarking: Vorla may embed an invisible identifier in the metadata (EXIF or XMP fields) of generated content, indicating "AI Generated by Vorla", to comply with industry transparency standards (e.g., C2PA specifications). This does not affect the visual appearance of the image and does not constitute a claim of ownership. You may retain or remove this metadata, though retention is recommended to respect industry norms.
- Mandatory Watermark Restrictions: As stated in Section 5.4 of our Terms of Service, "No removal of watermarks" means you may not remove watermarks from works that are legally owned by others (e.g., professional photographers, stock libraries). With respect to content you generate using Vorla, you are free to decide whether to add visual watermarks (the platform provides optional tools).
- Platform Use of Your Generated Content for Promotion: Unless we obtain your explicit separate consent, we will not use your generated content for Vorla's commercial advertisements, case studies, or social media promotion. We may invite you to voluntarily submit content for user showcase programs, but this is an opt-in mechanism.
9.2 Prohibition and Monitoring of Watermark Removal
- Explicitly Prohibited Conduct: As stated in Section 5.4 of our Terms of Service, you are strictly prohibited from using any Vorla feature (including but not limited to AI inpainting, content filling, local repainting, object removal, etc.) to remove, cover, blur, or tamper with watermarks, copyright notices, author attributions, or any ownership marks on images or videos that you do not own or for which you lack legal authorization.
Application Examples:
- ❌ Prohibited: Removing watermarks from preview images of stock libraries (e.g., Getty Images, Shutterstock) to obtain high-resolution versions.
- ❌ Prohibited: Removing attribution watermarks from professional photographers' works.
- ❌ Prohibited: Removing "Confidential" watermarks from internal company documents (unless you are authorized to do so).
- ✅ Permitted: Removing or modifying watermarks that you originally added to your own original works.
- ✅ Permitted: Removing watermarks from works for which you have obtained legal authorization (e.g., purchasing copyright, obtaining written permission).
Monitoring and Enforcement:
We may use automated detection tools to analyze whether uploaded images match known stock library watermark patterns or to detect attempts to obscure existing watermarks. Detection methods include but are not limited to:
- Image fingerprinting: Comparing uploaded images against a database of known commercial watermark features.
- Behavioral analysis: Multiple attempts to repair or fill the same area within a short period.
- Human review: Security reviewers may manually review cases where automated systems trigger high-risk alerts.
If our system detects or we receive a valid report that you have engaged in watermark removal, we will:
- Block the generation request and display a warning;
- Record the violation;
- For repeated violations or severe cases (e.g., bulk watermark removal), immediately terminate your account without refund, in accordance with Section 5.5 of our Terms of Service;
- If the original rights holder asserts a claim against us as a result of your conduct, we reserve the right to pursue recovery from you for all losses incurred (including attorneys' fees).
All detection is performed only as necessary for service operations. We do not permanently store images used for detection unless a violation is discovered and requires documentation.
10. Children's Privacy
We do not knowingly collect personal information from children under the age of 13 (or the age of digital consent in your country). If we become aware of such collection, we will immediately delete the information and terminate the account. If you are a parent and believe your child has provided us with personal information without your consent, please contact us at [email protected].
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. For material changes, we will notify you via email or a prominent notice on our website (as described in Section 11 of our Terms of Service). Your continued use of the services after the changes become effective constitutes your acceptance of the updated policy.
